These Terms of Service govern your access to and use of Kairos Health’s website and services, including the SMS text messaging terms and conditions in Section 4.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website kairoshealthai.com and the AI-powered patient intake, call handling, and scheduling services (collectively, the “Services”) provided by Kairos Health, Inc. (“Kairos Health,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. Description of Services

Kairos Health provides software that helps dental and orthodontic practices (“Clinics”) answer patient calls, capture intake and insurance information, and schedule appointments using each Clinic’s scheduling rules. We provide the Services to Clinics; patients interact with the Services primarily through the Clinic’s Kairos AI receptionist by phone and text message.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services or to consent to receive communications from us. By using the Services, you represent that you meet this requirement.

4. SMS / Text Messaging Terms

These messaging terms apply to text messages sent through the Services.

  • Program description. When you provide your mobile number and consent, you agree to receive SMS text messages from Kairos Health, sent on behalf of your dental or orthodontic Clinic, relating to appointment reminders and confirmations, new-patient intake, and scheduling (including booking and rescheduling).
  • Consent. Consent is obtained verbally during a phone call with the Clinic’s Kairos AI receptionist or staff. Consent to receive text messages is not a condition of receiving dental care or any purchase.
  • Message frequency. Message frequency varies based on your appointments and interactions with the Clinic.
  • Cost. Message and data rates may apply, depending on your mobile carrier and plan.
  • Opt-out. You can cancel text messages at any time by replying STOP. After you reply STOP, we will send a confirmation message and then stop sending text messages to your number. You may continue to receive dental care and contact your Clinic by other means.
  • Help. For help, reply HELP or contact us at contact@kairoshealth.dev.
  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.
  • Supported carriers. Messaging is available on major U.S. carriers, but we do not guarantee that messages will be deliverable to all carriers or devices at all times.
Reply STOP to unsubscribe at any time. Reply HELP for help. Message and data rates may apply, and message frequency varies. We never share mobile opt-in data or consent with third parties—see our Privacy Policy.

5. Acceptable Use

You agree not to:

  • Use the Services in violation of any law or regulation;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Attempt to gain unauthorized access to the Services or related systems;
  • Reverse engineer or copy any part of the Services except as permitted by law; or
  • Use the Services to transmit unlawful, harassing, or harmful content.

6. No Medical Advice

The Services support scheduling and administrative communications. They do not provide medical, dental, or clinical advice, diagnosis, or treatment. Always rely on your licensed dental or medical provider for clinical decisions. If you have a medical emergency, call 911 or your local emergency number.

7. Intellectual Property

The Services, including all software, text, graphics, and logos, are owned by Kairos Health or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services as intended. You may not use our trademarks without our prior written consent.

8. Third-Party Services

The Services may integrate with or link to third-party services. We are not responsible for third-party services, and your use of them is governed by their terms and policies.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Kairos Health and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us, if any, in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Kairos Health from any claims, damages, liabilities, and expenses arising out of your misuse of the Services or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Delaware, unless otherwise required by applicable law.

13. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
